Information Notice pursuant to Article 13 of Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data

In accordance with Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree No. 196 of 30 June 2003 (Privacy Code), as amended, we hereby provide the necessary information regarding the processing of personal data you provide.

This notice is also issued pursuant to Article 13 of the Privacy Code and the GDPR. It is also inspired by Recommendation No. 2/2001, adopted on 17 May 2001 by the European data protection authorities meeting in the Working Party established under Article 29 of Directive 95/46/EC, which identified certain minimum requirements for the online collection of personal data, particularly the methods, timing and nature of the information that data controllers must provide to users when they access web pages, regardless of the purpose of the connection.

Reference is also made to Directive 2002/58/EC, as amended by Directive 2009/136/EC, concerning cookies, and to the decision of the Italian Data Protection Authority titled “Identification of simplified arrangements for the information notice and the acquisition of consent for the use of cookies – 8 May 2014” (published in the Italian Official Gazette No. 126 of 3 June 2014), including subsequent clarifications.

1. Purpose and Legal Basis of Processing

The personal data and any special categories of data provided through this website will be processed by Genera Group (Genera New Energy S.p.A. Società Benefit and Genera Integrated Solutions S.r.l.) for the following purposes:

  • Recruitment and personnel selection purposes, including the possible establishment of a contractual relationship, training courses, internships or traineeships; to formalize the application and allow candidates to participate in recruitment processes and potentially become part of the Genera Group team;
  • Compliance with legal obligations, including obligations provided for by laws, regulations, collective agreements or EU legislation, particularly with regard to social security and welfare regulations, occupational health and safety, protection of public health, public order and security, and tax regulations;
  • Administrative and accounting purposes: for the purposes of applying data protection provisions, processing carried out for administrative and accounting purposes refers to activities related to organizational, administrative, financial and accounting functions, regardless of the nature of the data processed. In particular, such purposes include internal organizational activities and activities related to the performance of contractual and pre-contractual obligations, as well as information management.

2. Nature of Data Provision and Consequences of Refusal

The provision of personal data for the purposes indicated in Section 1 is necessary to use the specific functionality offered by the “Careers / Work With Us” section of the website and to correctly submit an application in order to participate in potential recruitment processes and potentially join the Genera Group team. Without providing such data, it will not be possible to submit your application.

In order to correctly submit an application, the candidate must provide consent to the processing of any special categories of personal data included in the application. Such special categories of data will be processed only with prior consent; without such consent, the candidate will not be able to complete the application process or submit their data for recruitment purposes.

Candidates submitting their application are responsible for verifying the accuracy of the personal and special category data provided.

3. Categories of Recipients of the Data and Purpose of Communication

The personal data and any special categories of data collected will not be disclosed, but may be communicated to third parties contractually linked to Genera Group, both within and outside the European Union, including in non-EU countries, in compliance with and within the limits set out in Chapter V of the GDPR, in order to fulfil contractual obligations or related purposes.

Data may be communicated to third parties belonging to the following categories:

  • Companies belonging to the Genera Group;
  • Technology service providers supporting Genera Group, such as providers of IT system management services, telecommunications networks, including email services, newsletters and website management;
  • Consultants or service providers assisting the Data Controller for the purposes indicated in this notice;
  • Competent authorities and other entities entitled by law or regulatory provisions to access such data for the fulfilment of legal obligations or instructions issued by public authorities.

The entities belonging to the above categories may act as Data Processors or operate independently as separate Data Controllers.

4. Types of Data Processed

Personal Data
Personal data refers to any information relating to an identified or identifiable natural person, directly or indirectly, particularly by reference to identifiers such as a name, identification number, location data, an online identifier, or one or more elements specific to their physical, physiological, genetic, mental, economic, cultural or social identity.

Special Categories of Data
Article 9 of the GDPR defines special categories of data as those revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, as well as genetic data, biometric data intended to uniquely identify a natural person, data concerning health, or data concerning a person’s sex life or sexual orientation.

The processing of such data may be carried out by Genera Group within the scope of the activities described in Section 1, provided that the data subject has given their explicit consent.

The Data Controller reserves the right to remove from its records any data received through the form in the “Careers / Work With Us” section if, upon verification, such data proves to be inaccurate, incomplete or not updated. The Data Controller may also request additional information necessary for the recruitment process.

5. Transfer of Data Abroad

Genera New Energy S.p.A. SB and Genera Integrated Solutions S.r.l. (Genera Group) are part of an international corporate group and, therefore, during processing activities, personal data may be transferred abroad (within EU countries), with or without the use of electronic or automated tools, for the purposes described in Section 1.

Any transfer of personal data to countries outside the European Union will be carried out in compliance with Chapter V of the GDPR.

6. Methods of Processing

Genera Group (Genera New Energy S.p.A. SB and Genera Integrated Solutions S.r.l.) processes personal data lawfully and fairly and in a manner that ensures confidentiality and security.

Processing is carried out using manual, electronic and telematic tools, with organizational methods and logic strictly related to the stated purposes.

Your data will be processed by authorized personnel (employees and/or collaborators), as well as by third parties performing support activities. Such parties will act as Data Processors or independent Data Controllers.

7. Rights of the Data Subject

With regard to the processing of personal data, data subjects are entitled to exercise the rights provided for by Chapter III of the GDPR and Article 7 of the Italian Privacy Code.

The data subject has the right to obtain confirmation as to whether personal data concerning them exists and to receive such data in an intelligible form.

The data subject also has the right to obtain information regarding:

  • the origin of the personal data;
  • the purposes and methods of processing;
  • the logic applied where processing is carried out with electronic tools;
  • the identification details of the Data Controller, Data Processors and the designated representative;
  • the recipients or categories of recipients to whom the data may be communicated.

The data subject also has the right to:

  • request updating, rectification or integration of data;
  • obtain data portability in a structured format;
  • request erasure, anonymization or blocking of data processed unlawfully;
  • obtain restriction of processing in the cases provided for by Article 18 of the GDPR;
  • receive confirmation that such operations have been communicated to recipients of the data, unless this proves impossible or involves disproportionate effort;
  • object at any time, for reasons related to their particular situation, to the processing of personal data pursuant to Article 6(1)(e) or (f) GDPR, including profiling based on those provisions.

8. Data Retention

Genera Group will retain your data for the period necessary to evaluate recruitment needs, and in any case for no longer than one year from the date of receipt of the data.

9. Links to Third-Party Websites

Genera Group is not responsible for the privacy policies adopted by other websites that may be accessed through links on its website. This Privacy Policy does not apply to the collection or use of personal information carried out by third-party websites.

10. Changes to the Privacy Policy

This Privacy Policy may be updated from time to time to reflect organizational changes or different methods of information processing. Information will always be processed in accordance with the Privacy Policy in force at the time the data is collected.
